Welcome to Empress Caviar. These Terms and Conditions ("Terms") govern your access to and use of empresscaviar.com (the "Site") and any purchase you make from us. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Empress Caviar sells premium caviar and related gourmet products directly to consumers within the United States through this Site. All references to "we," "us," or "our" refer to Empress Caviar.

2. Eligibility

You must be at least 18 years old and able to form legally binding contracts to place an order. By using the Site, you represent that you meet these requirements.

3. Products and Sourcing

We make reasonable efforts to accurately describe our caviar products, including species, origin (wild or farm-raised/aquaculture), grade, and harvest/packing information where available.

All caviar sold through the Site is sourced and sold in compliance with applicable U.S. Fish & Wildlife Service (USFWS) and CITES regulations governing sturgeon and paddlefish products. Product labels include required traceability information (species, country of origin/production, and lot or CITES-related identification code) where applicable.

Product images are for illustrative purposes; actual appearance, tin size, and roe color may vary naturally by harvest.

We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion, including to prevent fraud or resale outside acceptable use.

4. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice.

We reserve the right to correct pricing errors, including after an order has been placed, and will notify you before charging a corrected amount.

Payment is processed securely through Shopify's payment infrastructure (and/or our designated third-party payment processors). By providing payment information, you represent that you are authorized to use the payment method.

Applicable sales tax will be calculated and added at checkout based on your shipping destination.

5. Order Acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order; it is confirmation that we received it. We reserve the right to accept or decline any order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity.

6. Shipping

Shipping of our products, including cold-chain and perishable handling, is governed by our separate Shipping Policy, which is incorporated into these Terms by reference. You are responsible for ensuring someone is available to receive perishable shipments promptly.

7. Returns, Refunds, and Cancellations

Because caviar is a perishable, temperature-sensitive product, our return and refund process differs from non-perishable goods. Please see our Shipping Policy and refund guidelines below:

Orders may be cancelled only before they have shipped. Contact us as soon as possible to request a cancellation.

Due to food-safety concerns, we generally cannot accept returns of perishable caviar products once delivered, except in cases of damage, spoilage in transit, or incorrect items received — see Section 8 (Quality Guarantee).

Non-perishable, unopened merchandise (e.g., accessories, serving items) may be returned within 14 days of delivery in original condition; contact us to initiate a return.

8. Quality Guarantee

We stand behind the quality of our caviar. If your order arrives damaged, spoiled, significantly delayed due to carrier issues affecting cold-chain integrity, or incorrect, contact us within 24 hours of delivery with your order number and photos of the product and packaging, and we will offer a replacement, store credit, or refund at our discretion. Claims submitted after 24 hours may not be eligible, as caviar is highly perishable.

9. Intellectual Property

All content on the Site — including text, graphics, logos, images, product photography, and the "Empress Caviar" name and branding — is owned by or licensed to us and protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent.

10. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms

  • Attempt to interfere with the Site's security or functionality

  • Submit false, misleading, or fraudulent order or payment information

  • Reproduce, duplicate, or resell any portion of the Site or its content without authorization

  • Use automated means (bots, scrapers) to access the Site without permission

11. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

12. Third-Party Links and Services

The Site may integrate with or link to third-party services (e.g., payment processors, shipping carriers, social media). We are not responsible for the content, policies, or practices of third parties.

13. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN OUR QUALITY GUARANTEE.

Caviar is a raw, ready-to-eat fish product. Consuming raw or undercooked fish/seafood products may increase the risk of foodborne illness, particularly for pregnant individuals, young children, older adults, and people with weakened immune systems or fish/shellfish allergies. Please consult your physician if you have concerns.

We do not guarantee the Site will be uninterrupted, secure, or error-free.

14. Limitation of Liability

To the fullest extent permitted by law, Empress Caviar and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or products, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your order shall not exceed the amount you paid for the product(s) at issue.

15. Indemnification

You agree to indemnify and hold harmless Empress Caviar, its owners, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site shall be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction there.

17. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Continued use of the Site after changes constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
